Unenforceable Credit Card and
Loan Agreements

If you have a loan, or if you have purchased goods on credit to the value of £25,000 or less, then your lender should have provided you with a Regulated Credit Agreement. The content of the agreement has to conform to regulations in accordance with the Consumer Credit Act 1974 and should be signed and dated by both you and the lender to be properly executed.

The CCA is the legislation which explains the terms and conditions that a lender has to adopt when lending to consumers.  The CCA is in place to protect consumers when arranging credit and/or purchasing goods.


If I have a credit agreement – What happens next?

We will have the agreement audited.
Ÿ
Any breaches are assessed to determine if the loan is non complient.
Ÿ
You are then provided with a conclusion of the audit for each agreement setting out the grounds for litigation for each case.

What if I can’t find my credit card/loan agreement?
Don’t worry, we will obtain a copy of it for you free of charge.

Does this service apply to all Credit Cards and Loans?
We are currently only looking at credit cards and loans between £2,500 and £25,000 which were taken out before April 2007.

Didn’t I agree to the terms?
On the basis that the agreement was legal and complied with the regulations, you did so in good faith. BUT if the agreement wasn’t legal and breaches the regulations, then you should not have been asked to enter into it in the first place.

How can I proceed with a claim?
We have a number of options available and you can choose which one you prefer.

OPTIONS
OPTION 1

If the credit agreement you wish to challenge is in fact a credit card and then only if you intend to pay the fee of £250 by using this card would we suggest this method.

The fee covers the administration and the legal costs and if your claim is successful the total amount of debt outstanding on your card
including the £250 fee which you have paid will be unenforceable and consequently will be written off

However if at any time your claim is found to be unsuccessful the FEE WILL BE RETURNED IN FULL and there will be NO LEGAL COSTS.

OPTION 2

Under this option NO UPFRONT PAYMENT is necessary.
We will process your claim and provide you with legal advice up to and including establishment that your loan/credit card is unenforceable.  We will obtain a financial audit and will pursue the claim vigorously up to and including court action.
The fee of £499 is only payable after the claim has been successfully resolved.
However, if at any time your claim is found to be unsuccessful NO FEES WLL BE PAYABLE and there will be NO LEGAL FEES.


Payment Protection Insurance
Can I claim back Payment Protection Insurance Premiums (PPI)?
You may have grounds to reclaim Payment Protection Insurance premiums (plus interest on any loans you may have). We can discuss this with you and establish if you have grounds for compensation.  If you do, our solicitors will include this in the overall case against the lender. If you wish to make a claim for PPI a fee of 30% + VAT of the PPI compensation paid will be applied.

Does this apply only if Payment Protection Insurance was added to my loan?
No – even if you have taken out separate PPI (i.e. not connected to a specific loan) we can establish if you have grounds for compensation.


If you have you got a loan, or credit card
