Guide to Selling (Conveyancing)

Our step-by-step guide which is shown below will explain in detail each stage of your transaction.

Stage 1 (Sale Agreed)
1. When you have instructed one of our Property Lawyers they will obtain your title deeds and Land Registry copies. You will then be asked to complete a 'Property Information Form' and a 'Fixtures, Fittings and Contents Form.'

2. Any guarantees not held with your title deeds e.g. damp and timber reports, planning consents for alterations and extensions etc. will be requested from you.

3. The draft contract will be prepared and sent to your Buyers solicitors who will then ask us to answer any queries they may have. Once their queries have been answered you will be asked to sign the contract.
Stage 2 (Exchange of Contracts)

4. Once the contract is signed we can proceed to exchange. Only at this stage does the sale becomes legally binding. The Buyer's solicitors will send a deposit to us.

5. When we have approved the transfer deed you will be asked to sign it. We will also apply for any mortgage redemption figure and prepare the final accounts.

Stage 3 (Completion)

6. On the day of completion we will receive the balance of the sale price, in return for which we will hand over the title deeds.

7. We will redeem any mortgage out of the sale proceeds, pay off your legal fees and will forward any left over money to you, unless you are using it for a related purchase.

Guide to Buying (Conveyancing)

Stage 1 (Purchase Agreed)

1. When you have instructed us we must wait to receive the pre-contract package from the seller's solicitor. Following receipt of this, we can apply for the local authority search.

2. Any additional enquiries will be raised following which we will await the results. We will also await the search result and mortgage offer, and follow any instructions from the lender.
Stage 2 (Exchange of Contracts)

3. We will ask you to sign the contract and provide a deposit in order that we can then exchange contracts with the seller's solicitor. The sale is then legally binding.

4. Once contracts have exchanged we can prepare the final accounts and send the mortgage deed to you for signature.

5. Final searches are then made against the property and on you.

Stage 3 (Completion)

6. On the day of completion we will hand over the balance of the funds and receive in return the title deeds from the seller's solicitors.

7. If applicable, stamp duty is paid, and we will arrange to register the transfer at the Land Registry.
